Briefing

All copywriting services require a briefing, which is charged in addition to the price of the text, unless otherwise agreed in writing at the time of placing the order. The briefing can take place in person or over the phone. An initial meeting does not normally replace the briefing. Where appropriate, a checklist will be used. Communication with the client is usually by email or telephone. Unless otherwise agreed, I charge for the time spent on a test job, test translation or test concept at my usual hourly rate.

Delivery Time

The turnaround time after receiving a written order from the client is usually about 7 days, or as agreed. I deliver texts and translations as Word files via e-mail. Images are usually delivered as jpg files.

Prices, terms of payment

All prices are subject to VAT at the current rate. Payment is due within 14 days without any deductions. The fee is calculated according to the time required or a previously agreed fixed price. If the order deviates significantly from the briefing, so that the fixed price calculation deviates by at least 10%, the customer will be informed in good time. In this case, a recalculation is possible. Any travel expenses incurred will be charged on a time and material basis. Where possible, unnecessary travel expenses will be avoided. Payment costs, in particular for international bank transactions, shall be borne in full by the customer.

Late Payment

If payment is overdue, a one-time reminder will be sent. 30 days after the invoice date, I will pass the claim to a collection agency without further reminder. The cost of this will be borne by the defaulting payer. From the due date of the invoice, the usual bank interest for an overdraft will be charged. Services that have not been paid for in full may not be reproduced, distributed, published or used.

Reduced fees

In the case of long-term cooperation, a discount may be agreed upon, as the familiarization period for regular topics or similar assignments is reduced. The calculation of the fee does not depend on the size of the text. Experience has shown that the creation of short texts such as advertising copy or slogans is just as time-consuming as the creation of extensive texts.

Subsequent text changes

After full payment, the rights to use my texts and translations are transferred to you. You are free to edit the text as you wish. Please note: My wording and choice of words are carefully selected for use in a specific medium, e.g. on the web, in magazines or in a flyer. For the best possible result, I recommend that you discuss any changes or corrections with me.

Disclaimer of warranty

My texts and translations are accurate and of the highest quality. However, I cannot be held responsible for spelling mistakes. It is the sole responsibility of the client to ensure that the content does not violate any applicable laws.

Rights of use of texts, translations and images

The client acquires the rights of use to the texts, translations and images created for him only after the invoice has been paid in full. Unless otherwise expressly agreed in writing, any photographs supplied shall remain my property. The client acquires the rights of use agreed upon for the respective order. Each agreed upon and further use of the material is subject to a fee. In addition to the agreements made, the provisions of copyright law apply to any use. A copyright notice in accordance with § 13 of the German Copyright Act (UrhG) must always be included in such a way that there is no doubt as to the identity of the author and the attribution of the photograph. The agreed rights of use may not be transferred without my consent, even if the company or parts of it are sold. It is not permitted to falsify or distort the meaning of the images by adding or omitting text.

In the event of a breach of copyright or written agreements, any additional fees will be charged in accordance with the fee recommendations of the Mittelstandsgemeinschaft Foto-Marketing (MFM) or, in the case of text contributions, in accordance with the recommendations of the Mittelstandsgemeinschaft Wort (MFJ).

Jurisdiction, ancillary agreements

The place of jurisdiction is always Kempten/Allgäu, even if the customer’s terms and conditions state otherwise. German law also applies to deliveries abroad. Additional agreements require the written form.
